In the event that a user receives any service via a Spring Airlines Platform, this Policy constitutes an integral part of the agreement relationship with the service (no matter such agreement is reached orally, in writing or otherwise) and should be considered along with relevant terms of service. In this case, unless a term of service explicitly excludes its application, the legal notices herein shall be applied preferentially.
Where personal information is unfortunately leaked due to objective reasons such as Spring Airlines’ obligation to comply with legal provisions, force majeure, technical restrictions, etc., Spring Airlines shall not be liable for any losses that users may suffer as a consequence; in case there is a liable third party, Spring Airlines will assist users to hold the third party accountable. When Spring Airlines is found in violation of any legal provisions, the Company or responsible persons shall bear all legal liabilities according to law, including possible administrative penalties and criminal liabilities. Notwithstanding, under any circumstances that are not prohibited by law at the time when a claim takes place, as far as the claim under this Policy and relevant terms of service is concerned, unless Spring Airlines is proved to have violated mandatory legal provisions or committed active negligence or gross negligence that causes certain losses, Spring Airlines’ liability for compensating the losses suffered by users due to leakage of personal information is limited to the actual losses of users (all unproven losses or unreasonable expenses or expenditures shall not be deemed as actual losses), and shall be no more than twice the actual service charges received by Spring Airlines. Where a user is at fault for any loss, Spring Airlines shall be relieved or exempted from liability accordingly. In order to avoid disputes, if a user fails to notify Spring Airlines in a timely manner or take other reasonably expected stop-loss measures, Spring Airlines has the right to claim exemption from liability for compensating any subsequent losses that may be aggravated by such failure; Spring Airlines does not promise compensation for the sole mental impairment suffered by users.
All disputes arising from the validity, interpretation and application of the Privacy Policy shall be subject to Chinese laws and the exclusive jurisdiction of the competent court in Changning District, Shanghai, where Spring Airlines is domiciled.
